I only give legal advice face-to-face. A Chapter 7 bankruptcy is intended to free you from unsecured debts, such as credit cards, judgments, medical bills, and personal loans (not student loans). It is also intended to free you from any personal liability that might be left over after a repossession or foreclosure.
The following Questions and Answers apply primarily to Chapter 7 bankruptcy.
Q. Can I keep my house? Can we keep our cars?
A. Normally yes. Bankruptcy does NOT automatically mean you lose your house and cars. But it is complicated, so talk to me.
Q. Do they come to our house and take things?
A. No. (Unless you are absurdly wealthy.)
Q. What about my business debts?
A. If you are a sole proprietor, your business debts are personal debts, and may be dischargable.
If your business is a corporation, you have probably signed a personal guarantee for the debts. I will explain this.
Q. Can I stay in business?
A. That is a very complicated question, best discussed in person.
Q. Can I keep one credit card?
A. All debts must be included in the bankruptcy. You do not have to include a credit card that does not have a balance, but the bank will probably close it anyway.
Q. Will a Chapter 7 Bankruptcy stop a wage garnishment?
A. Normally Yes. However, if the garnishment is for taxes, child support, or other non-dischargable debts, it will probably start again when the bankruptcy is concluded.
Q. What is the "Means Test?"
A. I will explain. Generally, if you are struggling to pay your debts, and have no money left at the end of each month, you will probably pass the Means Test.
